Subject of this Privacy Policy

This policy (“Privacy Policy") governs the procedures by which Benelli processes the personal data which Benelli collects and receives, including data regarding your past use of Benelli’s products and services ("Personal Data"). Personal data consist of information concerning you which allows you to be identified, such as your name, address, email address or telephone number, and which is not otherwise in the public domain.

Benelli is a company which develops and produces motorbikes, with registered office at Strada della Fornace Vecchia, sn, 61122 Pesaro (PU), Italy, belonging to the Qianjiang group headquartered in Wenling, Zhejiang province, China.

How we collect your data

Benelli collects your Personal Data when you create an account on the Benelli website, when you subscribe to our newsletter, complete a purchase or contact us using one of our data collection forms on our website, and also when you use Benelli products or services, visit our website or visit the Benelli headquarters (“Services").

What kind of data we collect from you

The Personal Data we collect from you include your name, address, email address, IP addresses and data regarding the pages you visit and when.

Personal Data may include (1) Personal Data which you contribute and (2) Personal Data supplied to us through your use of the Benelli services.

  1. Personal Data which you contribute to us:
    • Your email address and your country/region when you register or when you access your personal account; if you use your social media account to access or register for a personal account on the Benelli website, we may also collect any information in the public domain associated to your social media account.
    • Your name, postal/shipping/billing address (including postcode), contact information, email address, credit card number or other payment service information when you purchase our products or pay-to-use services, or in relation to some customer assistance requests via our website.
    • Any other Personal Data which you disclose to us.
  2. Data deriving from your use of our Services:
    • Device information: e.g. device model, serial number, operating system version and type, IP address, MAC address, IMEI number and other unique identifiers of the device.
    • Register information: e.g. the settings and date/time of activation of your devices, the network you use to connect to our SERVICE, network status, telephone register data, standby status, chronology of incidents, interface of choice, browser type and language settings, diagnostics and use data, and your behaviour when using our Services.
    • Position information: e.g. version of your devices, GPS and Wi-Fi module, GPS signal, data identifying the Wi-Fi access points and mobile phone network repeater masts in the vicinity, timeband and local time when the device is used.

Other Personal Data we may collect:

  • Search term you used to find our website.
  • Recording of browsing behaviours, including the links clicked. We do this with the aid of cookies placed on your device when you visit our website and the contents of any form sent to us. Data we will not collect

  • We will not collect information about your browsing habits outside our domains (benelli.com in particular)
  • We will never ask you to contribute sensitive data such as information about your medical history or health, your political or religious beliefs, any presumed or proven offences or criminal convictions, your sexual orientation, history or behaviour, or genetic information. Please do not contribute these data to us.
  • We do not knowingly collect information from people less than sixteen (16) years of age, or from people below an equivalent minimum age in the relative jurisdiction, without their parents’ consent. We encourage parents (or guardians) to be actively involved in the child’s online activities and interests when using our Services. If you are a child, ask your parents for their consent before using our Services. You may not contribute your data to us without your parents’ consent. Your parents (or guardians) may withdraw any previously given consent, access request and request to correction of blocking or erasure of data at any time.

How we use your data

Benelli uses your data for the following purposes:

  • To improve and personalize the marketing and contents you see;
  • To fulfill your requests;
  • To notify you via email or telephone with regard to your request;
  • To assess and improve our Services;
  • To contact you with regard to a request for your personal data;
  • To process and fulfil any subscription you take out, including to our newsletters to keep up to date with the latest news and special offers and upcoming events. You can cancel your subscription at any time at no additional cost.
  • To provide anonymous notifications for internal use.

Your Personal Data will not be the subject of any automatic decision-making which may influence you, including but not limited to profiling activities.

Data security

We provide physical, electronic and procedural guarantees compliant with Italian laws and regulations to protect your data, including, but not limited to, those set forth in the General Data Protection Regulation no. 679/2016 (“GDPR"). We will ensure that we have adequate physical and technological measures to protect your data, wherever they are stored. However, Benelli is unable to guarantee perfect security on the Internet. To protect your data against unauthorised access, we advise you to:

  • Use alphanumerical passwords when registering a personal account on our website.
  • Change your passwords regularly.
  • Keep devices up to date, applying the latest software security updates available, and use tools such as antivirus/anti-spyware programs.

Who has access to your data

Benelli does not rent, sell or share personal data concerning you with other people or unaffiliated companies, except in order to supply products or services you have requested, when we have your permission, or in the following circumstances:

  • We believe it is necessary to share the data in order to investigate, prevent or pursue illegal activities, suspected fraud, potential threats to anyone’s physical safety or violation of the Benelli conditions of use, or as otherwise required by law.
  • We transfer the data concerning you if Benelli is acquired by or merged with another company. In this case, Benelli will notify you before the data concerning you are transferred and become the subject of a different privacy policy.
  • We restrict access to personal data concerning you to employees we consider have a reasonable need to come into contact with these data for the supply of products or services or to perform their duties. Our staff are trained regarding their data protection obligations.

Benelli cooperates with suppliers, partners, advertisers and other service providers in various sectors and categories of business.

How can I change or erase my data?

You are entitled (in the circumstances and on the conditions, and with the exceptions, envisaged by the relevant law), to:

  • Request access to the personal data concerning you which we process: this right enables you to find out whether we hold personal data concerning you and, if so, to obtain information about and a copy of the said data.
  • Request the rectification of your personal data: this right entitles you to have your personal data corrected if they are inaccurate or incomplete.
  • Object to the processing of your personal data: this right entitles you to ask Benelli to stop processing your personal data.
  • Request the erasure of your personal data: this right entitles you to request the erasure of your personal data, also when the data are no longer necessary for the achievement of the relevant purposes.
  • Request the restriction of the processing of your personal data: this right entitles you to ask Benelli to process your personal data only in limited circumstances, including with your consent.
  • Request the portability of your personal data: this right entitles you to receive a copy (in a structured, commonly used and machine-readable format) of the personal data you have contributed to Benelli, or to ask Benelli to transmit those data to another controller.

To the extent that the processing of your personal data is based on your consent, you will be entitled to withdraw this consent at any time by contacting us here. Bear in mind that this will not affect Benelli’s right to process the personal data obtained before you withdrew your consent, or its right to continue parts of the processing which have legal bases other than your consent.

Please note that in order to stop sending marketing and sales emails, we may need to conserve your email address. If you wish your data to be completely erased from our database, bear in mind that you could receive emails in the future if you return to our website and compile one of our data collection forms. How long do we store your data for?

We store your personal data for the time needed to pursue the purposes stated in this Privacy Policy, unless the law requires or permits a longer storage period.

We will continue to review and assess the quality of our data. We will implement and fulfil the data storage regulations relative to your data and we will ensure that your data are securely disposed of at the end of the appropriate storage time.

International transfer of personal data

You recognize and agree to the transfer, storage, use or processing of your data at/by Benelli and its affiliated companies and service providers which might be located in a country other than your own.
